This week it was announced that the DePuy ASR global settlement will be expanded to include additional claims totaling roughly 420 million dollars. The previous global settlement announced in November 2013 had a threshold of eligibility being that a revision had to occur prior to August 2013. The new deal includes claims where revision surgeries occurred after August 2013 to January 2015.
The details of deal have not yet been announced but it is anticipated that it will be substantially similar to the first global deal, having a “base award” and “enhancements”. The “base award” for the first deal was $250,000 with deductions for things such as time of the implant, age, BMI, and smoking. “Enhancements” including injuries stemming from the revision surgery such as re-revision, DVT, infection, foot drop, and use of pain killers.
