Johnson & Johnson’s Second Attempted Talcum Powder Bankruptcy Dismissed
I am pleased to inform you that Judge Kaplan dismissed LTL Management’s second attempted bankruptcy. Judge Kaplan noted in this opinion that LTL Management’s bankruptcy “does not meet the more exacting gateway requirement implemented by the Circuit with respect to ‘good faith’ . . ., which would allow LTL to take advantage of the tools available under the Bankruptcy Code to resolve its present and future talc liabilities.” This means that your talcum powder lawsuit can now move forward. However, Johnson & Johnson said on Friday that it would appeal Judge Kaplan’s findings to the Third Circuit Court of Appeals.
With the bankruptcy dismissal, we will resume the legal process to pursue justice and seek the rightful compensation you deserve for the harm caused by the talcum powder. Important Update Regarding Talcum Powder Litigation
As you are aware, you are one of our valued clients regarding the litigation against Johnson & Johnson and LTL Management for injuries caused by their talc-based products. Recently, there has been a notable development in a similar talcum powder case that went to trial. A recent jury verdict of $ 18.8 million dollars was rendered in favor of the plaintiff. The case involved a 24- year-old mesothelioma patient that had used J&J’s Baby Powder for many years. After deliberating for over a week, the jury found in favor of the plaintiff and assigned 100% of the responsibility to J&J. The jury assigned 0% of the responsibility to LTL Management.
While this verdict is indeed promising for individuals like yourself who have been harmed by talcum powder products, it is essential to remember that each case is unique and subject to its own specific circumstances. Past verdicts are not indicative of future outcomes, and J&J has promised to appeal the verdict. It is also important to point out that the verdict will not be paid while the LTL Management bankruptcy is still pending.

Johnson & Johnson targets scientists that published studies linking talcum powder with cancer.
Johnson & Johnson (J&J) recently sued four scientists because they published studies linking J&J’s Talc-based Baby Powder to cancer. In its complaint, J&J claimed that these well-respected scientists published inaccurate data about its Baby Powder, and that its Baby Powder did not contain asbestos. However, in 2019, J&J voluntarily recalled a lot of its Talc-based Baby Powder after the FDA found asbestos fibers in the product.
The U.S. Food and Drug Administration (FDA) is alerting consumers about Johnson’s Baby Powder Lot #22318RB. A sample from this lot was found to contain chrysotile fibers, a type of asbestos.
In 2020, J&J announced that it was pulling all talcum powder baby powders from the North American market. It is clear to us that J&J’s Talc-based Baby Powder is carcinogenic and J&J should focus on compensating victims and stop suing scientists that seek to inform the public of the risk associated with these products.

Status of the Talcum Powder Lawsuit
As you are aware, our law firm has been representing you in the talcum powder lawsuit against Johnson & Johnson and now LTL Management. We have been diligently working on your case and pursuing your legal rights to seek compensation for the injuries and damages you have suffered due to the link between talcum powder use and cancer. As for the New Jersey Bankruptcy Motion to Dismiss Hearing: This week, there have been significant developments in the talcum powder litigation, particularly regarding LTL Management. The company has filed for bankruptcy protection under Chapter 11 of the United States Bankruptcy Code.
All this week the Bankruptcy Court has heard arguments regarding the Motion to Dismiss the bankruptcy proceedings. The purpose of this hearing is for the Court to determine if LTL Management was in immediate financial distress when it filed for its second Bankruptcy. This week the Court heard numerous times that LTL Management was not in financial distress and in fact had sufficient funds to cover all its liabilities.
Next Steps: Judge Kaplan will issue his opinion on the Motion to Dismiss in the next 30 days. Depending on if he dismisses or allows the Bankruptcy to stand, we will take the necessary actions to protect your rights and seeking the compensation you deserve.

UPDATE – June 6, 2023
After over 18 months of delay in Bankruptcy Court, the United States Court of Appeals for the Third Circuit issued a tremendous and long-awaited victory for over 38,000 talcum powder plaintiffs. In holding that J&J’s controversial bankruptcy plot was not made in “good faith,” the Third Circuit took a stand against J&J’s attempt to evade justice by hiding behind bankruptcy laws.
Since then, a lot has occurred. That same day, J&J refiled chapter 11 bankruptcy alleging that it now had the support of thousands of talcum powder claimants. As you may have seen, J&J has proposed to fund the bankruptcy settlement to the tune of 8.9 billion dollars. This may seem like a lot of money, but please keep in mind that the proposed settlement would include all current and future ovarian cancer victims, all current and future mesothelioma victims, all attorney general actions for all states, and all other talcum powder related claims.
The Miller Firm is opposing J&J’s second bankruptcy attempt because we believe it undercuts the pain and suffering J&J’s products have caused our clients.
