Zantac UPDATE – December 6, 2022
On December 6, 2022 the federal judge overseeing the Zantac Multi-District Litigation (MDL) has dismissed every Zantac claim in her court on the grounds that Plaintiffs’ experts did not establish a sufficient scientific basis for the claims to go forward. In a lengthy Order, the court ruled that the Plaintiffs failed to meet their scientific burden of proof showing that the NDMA in Zantac increased the risk of developing cancer. This is very disappointing as this likely leaves thousands of cancer victims without further recourse for compensation.
The vast majority of Miller Firm LLC cases were not filed but tolled in the MDL Court’s registry program. This committed these cases to jurisdiction in the MDL so the decision would apply to any future case claimants can file. Unfortunately, due to the prospects of appeal the Miller Firm LLC, will not be filing and appealing actions that were tolled in the registry program. If your case was tolled and you desire to pursue an appeal, you will need to obtain other counsel and file complaint and a notice of appeal within 30 days of December 6, 2022.
