TRANSVAGINAL MESH UPDATE
Please see the upcoming trials here. But we wanted to provide you a summary of trials to date. Further, please note the general update is that so far only Endo/American Medical Systems (AMS) has began substantive settlement talks. The Miller Firm is engaged in preliminary talks with AMS but has not finalized anything to date.
Here is a list of trial verdicts to date. Overall, the litigation has been widely successful with significant compensatory and punitive damages awards. We hope these results will draw the other manufacturers into settlement discussions and the offers reflect the significant damages they have inflicted on so many victims.
Manufacturer Date Venue Result
Bard (Avulta) July 2012 CA 5.5 Million
Bard (Avulta) Aug 2013 WVA MDL 2 million
Ethicon (gynecare) Feb 2014 WVA MDL Defense verdict- judgement as a matter of law
Ethicon (TVT) April 2014 TX 1.2 Million
Ethicon (gynecare) Aug 2014 NJ 11.1 Million
Boston S (obytrix) Aug 2014 MA Defense verdict
Boston S (obytrix) Sep 2014 WVA MDL 73.5 million—reduced to 34.6 million
Ethicon (TVT) Sept 2014 WVA MDL 3.25 Million
Boston S (Pinnacle) Nov 2014 WVA MDL (FLA) 26.7 million verdict–4 plaintiff
Boston S (obytrix) Nov 2014 WVA MDL 18.5 million–4 plaintiff
Obviously, we are generally very happy with the success of the trials to date. The WVA multi-district litigation trying 4 plaintiffs at a time is particularly good news as it diminishes the bottling effect, a tactic used by these manufacturers to delay trials and lower settlement values. We will keep you posted with further results as they come in.
